Terms of sale


1 -RATES

The published rental rates, taxes and included services, are applicable from 1 January 2015.
Rates for stays distributed by Vitalparc have no contract value and may be modified without notice. The contract price is set when booking.
The price set when booking includes: For the apartments and villas rental:
– The rental of an apartment or a villa from 5 pm on the day of arrival and until 10 am on the day of departure. (Unless exceptional circumstances)
– The water, electricity and heating consumptions.
– The rental of linen (sheets, pillowcases, bathroom towels and 2 tea towels) based on the number of persons planned when booking.
– Linen changed at the start of each week for stays that exceed 07 days.
– End of stay cleaning, except for the kitchen corner and the dishes.
– The applicable VAT rate
– Access to the outdoor pool (not heated, unattended) from May to September on hours indicated on site.
– The outdoor play spaces (children’s play area, table tennis, compact mini-golf, library) For the rental of a hotel room:
– The rental of a room from 3:30 pm on the day of arrival and until 11 am on the day of departure. (Unless exceptional circumstances)
– The hotel services including: daily room cleaning, bathroom towels changed every day.
– The applicable VAT rate
– Access to the outdoor pool (not heated, unattended) from May to September on hours indicated on site.
– Access to the relaxation area (hammam, heated pool, Jacuzzi, aromatherapy room) of the Vitalparc Spa (from 3 pm to 7 pm).
– The outdoor play spaces (children’s play area, table tennis, compact mini-golf, library, Fitness room)
– – School holiday mini-club only from Monday to Friday according to availability) The price set when booking does not include:
– All services that are not mentioned above.
– The cancellation insurance and trip cancellation insurance.
– The tourist tax collected by the local authority from 1 April to 31 October Tourist tax rates:
Villa & apartment: 0.44 cents per day per person over the age of 13 Hotel: 0.99 cents per day per person over the age of 13 Changes in rates:
The contract price is subject to change without notice, within legal and regulatory limits when there are, between the booking date and the date of the payment of the balance, variations among applicable VAT rates, new taxes implemented, etc.

2 – REGISTRATION AND BOOKING:

Any booking request must be made by a legal person to Vitalparc by telephone or by writing.
The booking will only become effective on receipt:
– Of the booking voucher indicating: the dates of your stay, the type of accommodation selected, the list of natural persons staying on the site and the additional services selected.
– Of the deposit amounting to 30 % of the reserved stay. (the balance must be paid at the latest 30 days before your stay, or immediately for any last minute booking as set forth in article 3 of the general terms and conditions of sale)
Within the 15 days following receipt of these elements, a confirmation of stay indicating all the services selected will be sent to customer.
The resale of timeshare or any other Vitalparc product cannot be made without the express approval of Vitalparc.

3 – TERMS OF PAYMENT:

A deposit of 30 % of the total price of the reserved services must be paid when booking, as well as application fee (€ 15) for any apartment and villa booking.
Any global rental amount less or equal to € 150 must be paid when booking.
The balance is payable at the latest 30 days before the arrival date.
In the event of non-compliance with payment deadlines, Vitalparc reserves the right to unilaterally terminate the agreements without refunding the sums paid.

4- CONDITIONS FOR MODIFICATION AND/OR BOOKING CANCELLATION POLICY*:

Modifications to booking:
Bookings can be modified up to 30 days before the arrival date and are subject to availability. Modifications allowed will give rise to a price increase or a price supplement possibly due for new reserved services.
A booking cannot be exchanged or resold to a third party, in any way whatsoever. Disclosing any such practice may expose its author, and any person involved in its realisation, to appropriate proceedings, including legal ones.
Booking cancellation:
In the event of cancellation more than 30 days before the arrival date, Vitalparc will keep the application fee and deposit paid when booking.
In the event of cancellation less than 30 days before the arrival date, the total price of the stay will be charged and kept by Vitalparc, which will assume an obligation within the same limits, on the assumption that it is terminated to the prejudice and detriment of Vitalparc.
An early departure or a late arrival will not lead Vitalparc to any refunding. (Unless a cancellation insurance is paid)

5 – DAMAGES:

The property’s equipment and facilities must be used for the purposes intended. Any deterioration of the premises, loss or destruction of items of movable property that fit the accommodations or buildings with common access, engages the full responsibility of its author. The renter is personally responsible for any damages, losses or deteriorations, to its accommodation or any facilities of the site, caused by persons staying with or visiting the renter.

6 – RESPONSIBILITIES:

Vitalparc will not assume any responsibility, beyond its legal responsibility, in the event of:
– Theft, loss or damage of any kind, during or after a stay.
– Failure or stoppage of technical equipment, failure or closure of the site’s facilities.
– One-off measures, taken by the site’s management, of limitation on accessing certain facilities, including Spa, pool and pony park, required to comply with safety standards or for periodic maintenance.
The Management and organisers will not be responsible for any accidents that may occur during sport activities or others, on the site or outside. Customers participation in activities (children mini-club etc.) engages their responsibility and their personal insurance. Children participating in activities, do so with their parents’ tacit agreement and under their full responsibility.

7 – DEPOSIT:

Customers are required to take care of the rented property and of all equipment available on the site.
A deposit of 250 euros per apartment and per villa will be requested from the renter upon its arrival. The renter will have to check the material and equipment available on its arrival.
Any claim must be made on the day of arrival to the management or its representative. After this date, the material and equipment will be deemed to be in conformity.
On departure, provided that the rented property is left tidy, the deposit will be entirely returned. If departure is outside the opening hours of our offices, it will be sent by mail within a few days. The return of the deposit does not cancel potential proceedings resulting from disorders subsequently noticed.

8 – PET:

Only one pet is accepted per accommodation at additional cost, provided that it was declared when booking, it does not affect the tranquillity and security of residents and that the basic hygiene and integrity rules of the facilities are respected. It must be leashed. Its updated vaccination certificate will have to be presented. Tattoo is compulsory. Pets are not allowed: at the Spa, the outdoor Pool, the restaurant and the equestrian centre. Pets must not be left alone in the accommodations. Any deteriorations made by a pet will be charged in full to its master.

9 – RULES AND REGULATIONS:

Customers are aware of the existence of rules and regulations. They will be issued on the day of arrival and will be available at any time on site. Customers are especially requested to respect:
– The driving speed limit on the site: 20 km/h
– The circulation areas for cars and bicycles (Any vehicles are strictly forbidden in the Pony park)
– The peace of nights
– etc.
Failure to comply with these rules and regulations may lead to excluding the customer(s) without refunding the sums paid.

10 – CLAIMS:

Any claims relating to the course of the stay must be made on site to the site’s Management so that they can find an immediate solution. Our teams are at your disposal during your stay to solve potential noticed dysfunctions and to help you fully enjoy your stay. Failing that, the stay will be deemed, by express agreement, to have taken place in satisfactory conditions. The courts of Fréjus (83) will be the competent jurisdiction.

11 – COMMENTS:

The sites’ Management accepts no responsibility with regard to the opening hours, the reception and the potential accidents directly relating to the Parcours Aventure Forestier managed by the Aquitaine Raid company.
